    Terms of Service

    1. Acceptance of Terms

    By accessing or using the PlayerOS platform ("Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

    2. Description of Service

    PlayerOS is a communication platform designed for casino and gaming operators. The Service includes player database management, multi-channel campaign tools, a branded player inbox web application, journey automation, and related analytics and reporting features.

    3. Account Registration

    You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must immediately notify us of any unauthorized use.

    4. Acceptable Use

    You agree not to use the Service to send unsolicited communications in violation of applicable laws (including TCPA, CAN-SPAM, CCPA), upload malicious code, attempt to access other customers' data, resell the Service without authorization, or use the platform for any illegal purpose.

    5. Data Ownership

    You retain ownership of all data you upload to the platform, including player records, campaign content, and configurations. We process your data solely to provide the Service and do not use it for any other purpose. Upon termination, you may export your data within 30 days.

    6. Billing & Payment

    Fees are based on your selected plan, number of properties, and messaging usage. Platform fees are billed monthly in advance; messaging fees are billed monthly in arrears based on actual usage. All fees are non-refundable except as required by law.

    7. Service Level

    We target 99.9% uptime for the core platform. Scheduled maintenance windows will be communicated in advance. We are not liable for downtime caused by factors outside our reasonable control.

    8. Limitation of Liability

    To the maximum extent permitted by law, PlayerOS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.

    9. Termination

    Either party may terminate the agreement with 30 days' written notice. We may suspend your access immediately if you violate these terms. Upon termination, your right to use the Service ceases, and we will delete your data after a 30-day grace period unless otherwise required by law.

    10. Governing Law

    These terms shall be governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.

    11. Changes to Terms

    We may update these terms from time to time. Material changes will be communicated via email or platform notification at least 30 days before they take effect. Continued use after changes constitutes acceptance.
